Divorce Opinion Letter

If you were divorced outside Canada and wish to be remarried in Canada

You will need to obtain the following:

A legal opinion from an Ontario lawyer, addressed to both applicants, giving reasons why the divorce or annulment should be recognized in the Province of Ontario.

To get started, please deliver the following five items to our office by mail or courier:

  1. An original or court-certified copy of your divorce decree.
  2. A completed statement of sole responsibility for each divorce that needs to be signed by both parties of the marriage.
  3. A completed Application for Marriage.
  4. If you did not reside in the divorce-granting jurisdiction for at least one year immediately preceding the application for divorce, a written statement from one of the divorced parties confirming that at least one party to the divorce resided in the divorce-granting jurisdiction.
  5. Instant (money order/certified cheque) full payment for the opinion letter in the amount of $400 (Canadian funds).

Please note that in order to minimize cost and delay we discourage meetings with clients. Once we receive the above information, we provide express service for opinion letters. We can complete the opinion letter within a week of receipt of all the information itemized above and send it to you by mail/courier.

 

Getting Married in Ontario, Canada

Congratulations on your decision to get married! In Ontario, you have the choice of getting married in a civil or religious union.

Persons at least 18 years of age may get married in Ontario, to a member of the same or opposite sex. Individuals 16 or 17 years or age may get married with written consent of both parents. Other restrictions may apply.

At least one party of the marrying couple must be present to apply for a marriage license. You will need to bring a valid form of identification for both parties. Valid forms of I.D. include a birth certificate (and any change of name certificates), a current passport, a Record of Immigrant Landing or Canadian Citizenship card, PLUS one piece of photo identification, such as a driver's license or health card. Application fees may vary by location, so contact your local Marriage License Issuer. An additional fee applies for a civil marriage. Click here to download a marriage license application.

If you were divorced in Canada

Contact your local municipal office for information on obtaining a marriage license. You will need to bring an original or court-certified copy of the final divorce decree when applying for your license.

If you were divorced outside Canada

You will need to obtain the following:

  • An original or court-certified copy of your divorce decree
  • A statement of sole responsibility for each divorce that needs to be signed by both parties of the marriage
  • A legal opinion from an Ontario lawyer, addressed to both applicants, giving reasons why the divorce or annulment should be recognized in the Province of Ontario. I will write a divorce opinion letter for you for $400. Contact me for more information.
